This is the last Will and Testament of me Richard Ash of Goadby Marwood in the County of Leicester Farmer
I appoint my wife Mary Ash and my nephew Robert Mackley (the son of my wifes sister Hannah Mackley) to be the executors of this my will
I bequeath all my wearing apparel linen and consumable household stores to my said wife absolutely
I devise and bequeath all my real and residuary personal estate unto and to the use of my said wife Mary Ash and my said nephew Robert Mackley Upon trust that they the said Mary Ash and Robert Mackley or the survivor of them or the executors or administrators respectively of such survivor or the trustees or trustee for the time being of this my will shall sell collect or otherwise convert the same into money and shall with and out of the moneys to be thereby produced pay my funeral and testamentary expenses and debts And shall invest the residue of the same moneys And shall pay the income to be thereby produced to my said wife during her life without power of anticipation
And from and after her decease shall stand possessed of the said trust premises and of the income thereof respectively In trust as to the sum of Seventy five pounds part thereof for my brother Arthur Ash and as to the further sum of Forty pounds for my niece Mary Elizabeth Clifton (the wife of Thomas Clifton) absolutely if she shall survive me and my said wife And as to the further sum of Forty pounds for my wifes sister Catherine Lowe absolutely if she shall survive me and my said wife and as to the residue of the trust premises In trust for my said nephew Robert Mackley absolutely
Provided also and I declare that the trustees or trustee for the time being of this my will may defer and postpone the sale collection and conversion of the whole or any part or parts of my said real and residuary personal estates respectively so long as to such trustees or trustee shall seem proper but my residuary real estate shall for the purpose of transmission be impressed with the quality of personality from the time of my death and I empower the said trustees or trustee to continue for such period as they may think desirable any business or businesses in which I may be engaged at the time of my death and to engage and employ such foreman workmen laborers and others and to make such expenditure in and in connection with such business or businesses as the said trustees or trustee may think fit And I declare that the net rents and profits and other income produced from every or any part of my said real and residuary personal estate previous to the sale and conversion thereof shall be applied in the same manner in all respects as if the same were income proceeding from such investments as are hereinbefore directed or authorised and that the whole of the income produced from my said real and residuary personal estate shall as well during the first year from my death as at all times afterwards be applied as income under the trusts of this my will no part thereof being in any event liable to be retained as corpus or capital

This is the last Will and Testament of me Simon Bagworth of Goadby Marwood in the County of Leicester Cordwainer
I Give and devise unto my Wife Ann Bagworth All that Cottage or Tenement at Wikeham in the said County of Leicester in the occupation of Thomas Morris To hold to her the said Ann Bagworth to receive and take the rents and profits thereof during her life and from and after her decease I Give the same to my Grandson Thomas Cook of Melton Mowbray To hold to him his Heirs and Assigns for ever
I Give unto my said Wife Ann Bagworth for and during her life (subject to my debts and funeral Expences) All and singular my Household Goods and personal Estate whatsoever for her use And after her decease I Give two thirds of my said personal Estate and Effects unto my Daughter Ann Cook her Executors or Administrators And the other third part thereof to my Son John Bagworth his executors or administrators
And I appoint my said wife Ann Bagworth sole Executrix of this my last [“will” missing] and testament

This is the last Will and Testament of me John Barker of Goadby Lodge in the Parish of Goadby Marwood in the County of Leicester Farmer that is to say
Subject to the payment of all my just debts funeral and testamentary expences I give and bequeath unto my father Daniel Barker of Goadby Marwood aforesaid Farmer William Cowlishaw of Tonge in the said County of Leicester Farmer and James Goodson of Eastwell in the same County Farmer their executors and administrators All my farming and grazing stock implements of husbandry household goods and furniture and all other my personal estate and effects whatsoever and wheresoever Upon trust to permit and suffer my dear Wife Mary Barker to have the full and free use benefit profit and enjoyment thereof and of every part thereof during so long time as she shall continue my Widow Subject nevertheless to the payment of one hundred pounds apiece to all and every of my children which I give and bequeath to each of them as and when they shall severally attain their respective ages of twenty one years
Provided always that in case my said Wife shall marry again previous to my youngest child attaining the age of twenty one years then I will and direct my said Trustees the said Daniel Barker William Cowlishaw and James Goodson or the survivors or survivor of them or the executors or administrators of such survivor to require and take such security as they shall approve of from my said Wife for the due payment of the respective Legacies of one hundred pounds to my said children or to such of them as shall not then have received their Legacies or otherwise to sell and dispose of such part of my said personal estate and effects or the produce thereof as will be sufficient to answer and satisfy the same and deliver over the remainder to my said Wife for her own use and benefit
Provided always nevertheless that in case my said Wife shall depart this life before my youngest child shall have attained the age of twenty one years then I give and bequeath all my said personal estate and effects unto and equally between all my said children or their lawful issue share and share alike but the issue of any deceased child only to take his her or their parents share and in case any of my said children shall have received his or her Legacy of one hundred pounds or any part thereof such Legacy or part to be considered as part of his or her share of the said personal estate and to be deducted from his or her share of the same accordingly
Provided further that when and as soon as all my said children shall have attained their respective ages of twenty one years and they shall have been paid their respective Legacies of one hundred pounds each then I give and bequeath all the residue and remainder of my said personal estate and effects unto my said Wife to and for her own use and benefit
I appoint my said Trustees and my said Wife joint Executors and Executrix of this my Will
And my will and meaning is and I do hereby declare that my said Trustees and Executors their respective executors administrators and assigns shall and lawfully may by and out of the monies and effects which shall come to their respective hands by virtue of the trusts of this my Will retain to and reimburse themselves respectively all such loss costs charges damages and expences as they or any or either of them shall or may sustain or be put to by reason or on account of the trust aforesaid or any thing relating thereto
And further that my said Trustees and Executors shall not be answerable or accountable for any monies to be by them placed out at interest or deposited for safe custody or otherwise that may be lost unless it be through their or his own wilful neglect or default And that they shall not be answerable or accountable the one for the other of them but each of them only for his or her own separate acts deeds receipts neglects and defaults
And I further particularly declare that my said Trustees or any of them their executors or administrators shall not be answerable or accountable for the acts deeds management receipts neglects and defaults of my said Wife
Lastly I hereby revoke and make void all former and other Wills by me at any time heretofore made and do declare this to be my last Will and Testament
In witness whereof I the said John Barker the Testator have to this my last Will and Testament contained in this and the preceding sheet of paper set my hand and seal to wit my hand to the preceding sheet and my hand and seal to this second or last sheet thereof the Twenty ninth day of January in the year of our Lord one thousand eight hundred and thirty two

They being duly sworn as well to the faithful Execution of the Will as that the Testators Goods Chattels and Credits without deducting any debts due and owing by him therefrom do not amount in value to the sum of Four hundred and fifty Pounds

This is the last Will and Testament of me John Gardner Barker of Goadby Marwood in the County of Leicester made this twenty seventh day of September in the year of our Lord one thousand nine hundred and four
I hereby revoke all Wills made by me at any time heretofore
I appoint John Barker Farmer Ragdale and Charles Goodland Farmer Great Dalby to be my Executors and direct that all my Debts and Funeral Expenses shall be paid as soon as conveniently may be after my decease
I give and bequeath unto my Son John my Watch & Chain, Bureau, Gun, and Wardrobe to my daughter AM Morley the sum of Five pounds for her 2 daughters, Edna & Hylda
I also direct that my Rifle prizes to be divided between my 3 children
To my Wife Maria Barker the Stock & c on the farm, should she decline Agricultural pursuits my son John to have the farm and the use of the dead stock, and Valuation on the farm, at the Rate of 3½ per cent, the live stock to be sold, the money to be invested, or put out to use, the Interest (in each case) to be paid to the said Maria Barker as long as she remains my Widow, at her death the Estate to be realised and divided between my 3 children, John, Horace, and Annie Mary their Heirs, or assigns

This is the last Will and Testament of me Stevenson Gilbert Bellairs of Goadby Marwood in the County of Leicester Clerk in Holy Orders
I give and bequeath to my dear Wife Florence Elizabeth the sum of Two hundred pounds and I direct that such Legacy shall be paid to her immediately after my decease
I give and bequeath unto my Trustees hereinafter named their executors and administrators all my Silver plate (except that hereinafter mentioned) books and pictures Upon trust to permit my said Dear Wife to possess use and enjoy the same during her life she keeping the same properly insured against fire and properly preserving the same from deterioration reasonable wear and tear excepted and after her death Upon Trust for my Son Gilbert Nigel Mowbray Bellairs absolutely if he shall attain the age of Twenty one years but if he shall not attain that age then I direct that the same shall sink into and form part of my residuary estate
I declare that (if my Wife shall survive me) an inventory of the said Silver plate books and pictures shall be made as soon as conveniently may be after my death and signed by my said Wife and that such inventory shall be kept in the custody of the said Trustees or Trustee and that they or he after taking such inventory and procuring the same to be signed by my said Wife shall not afterwards during her life be in any way liable for or concerned to see to the custody insurance or preservation of the said articles and effects or any of them
I give and bequeath all my household goods and furniture ornaments wearing apparel (and any silver plate which may have belonged to my said Wife before her marriage or which she may hereafter acquire from her own family or I may acquire in her right) plated goods linen china and glass horses and carriages wines spirits and provisions in and about my house at Goadby Marwood or in or about my residence at the time of my decease and any ready money which may be in such house at the time of my decease unto my said Dear Wife absolutely
I appoint my Brother George Clarke Bellairs and my friend William Jesse Freer of Knighton in the County of Leicester Gentleman (hereinafter called “my Trustees”) Trustees and Executors of this my Will
I give and devise all my real estate whatsoever and wheresoever including the perpetual Advowson Donation right of patronage and presentation of and to the Rectory and Parish Church of Goadby Marwood aforesaid And also all my estate and interest in the Advowson right of Patronage and Presentation of and to the Parish Church and Rectory of Stockerston in the County of Leicester with all and singular the glebe lands tithes rights and appurtenances thereto respectively belonging (but excepting all estates vested in me as a Trustee or Mortgagee) unto and to the use of my Trustees their heirs and assigns To hold the same Upon trust that they or the survivor of them or the heirs or assigns of such survivor do and shall at any time or times hereafter upon the request in writing of my said Wife during her life and after her decease at their or his discretion (but subject to such discretionary powers as to the said Advowsons as are hereinafter contained) sell and absolutely dispose of the said devised hereditaments and real estate or any part or parts thereof either together or in parcels and either by public auction or private contract to any person or persons whomsoever for the best price or prices that can be reasonably obtained and which they or he shall approve of accepting for the same (with power to make any special or other conditions of sale or any stipulations as to title or evidence of title or otherwise and to buy in all or any part of the said estates at any such sale by Public auction or to rescind any Contract and to resell the premises without being answerable for loss) and do and shall make and execute such Conveyances or other assurances for effecting such sales and I give to the Trustees or Trustee for the time being of this my Will discretionary power to postpone for such period as to them shall seem expedient the sale of all or any part of my real estate and I direct that until such sale or sales the rents and profits of such real estate shall be paid to the person or persons who under the trusts hereinafter contained would be entitled to the income and proceeds of the moneys arising therefrom if the same were sold and the moneys arising from such sale were invested in manner hereinafter directed
And I direct that the clear moneys to arise from the sale of my said real state shall be applied and disposed of according to the trusts and purposes hereinafter expressed of and concerning the same Provided always and notwithstanding that the said Advowson of Goadby Marwood and my estate and interest in the Advowson of Stockerston are respectively included in the general trust for sale hereinbefore contained of my real estate
I hereby empower the Trustees or Trustee for the time being of this my Will to act as regards the said advowson or the next or any future presentation to the livings of Goadby Marwood and Stockerston or either of them in manner hereinafter expressed that is to say
Upon trust to sell the next or any future presentation of the said livings or either of them from time to time for such price as they or he shall think fit the moneys arising from such sale or sales to be considered as part of my general residuary estate and also if it should happen that a vacancy or vacancies should occur in the said livings or either of them before the sale of the said advowsons or either of them and without any sale having been made of the presentation on such vacancy then Upon trust to present such person or persons to the said living or livings as the Trustees or Trustee for the time being of this my Will (with the consent in writing of my said Wife during her life and after her decease at their or his discretion) shall think fit taking or not taking from the person or persons so presented such Resignation Bonds in favour of any Son of mine or any husband of any daughter of mine as shall be legal as the said Trustees (with such consent or at such discretion as aforesaid) shall think fit And also to present any Son of mine or any husband of any daughter of mine to the said living or either of them Provided always and I hereby declare that if the Trustees or Trustee of this my Will shall not think to resort to a sale of the said Advowsons or Advowson and if no child of mine shall attain the age of Twenty one years I devise the said Advowsons or Advowson to my own right heirs for ever
I give and bequeath all my ready money securities for money and all other my personal estate and effects whatsoever and wheresoever (not hereinbefore disposed of) unto my Trustees their executors administrators and assigns Upon trust to collect get in and convert into money all such parts of my said personal estate as shall not consist of money or eligible securities for money and I direct that the Trustees or Trustee for the time being of this my Will shall stand possessed of as well the money to arise from my said residuary personal estate as the money to arise from the sale of my said real estate as one general fund Upon the trusts following namely
Upon Trust in the first place to pay all my just debts funeral and testamentary expences and legacies and after such payments Upon trust with the consent of my said Wife during her life and after her decease then in the discretion of the Trustees or Trustee for the time being of this my Will to lay out and invest such clear residue and surplus of my said real and personal estates in their or his names or name in or upon any of the stocks funds or securities of the United Kingdom or in or upon any real security in Great Britain and not elsewhere or in or upon Debentures or Mortgages of any Railway Canal or Dock Company or Companies or other similar Company or Companies in England established and incorporated by Authority of Parliament with power from time to time with such consent or in such discretion as aforesaid to vary the securities in or upon which such investment shall be made for any other investment or investments of the descriptions aforesaid And do and shall stand possessed of and interested in the residuary trust moneys and premises so to be invested as aforesaid and the interest dividends and annual produce thereof upon the trusts next hereinafter declared concerning the same (that is to say)
Upon Trust to pay the annual dividends interest or income of all the said trust moneys or the stocks funds or securities wherein the same shall be invested unto my said Wife Florence Elizabeth and her assigns for her life if she shall continue my Widow without power of anticipation but if my said Wife shall marry again then Upon Trust out of the said annual income of the said trust moneys and premises to pay unto my said Wife an annuity or yearly sum of Two hundred and fifty pounds during her life upon her single receipt for her separate use and free from marital control and engagements but without any power for her to anticipate the growing payments thereof And I direct that the said annuity shall be paid without any deduction by equal quarterly payments in every year the first payment of the said annuity to be made on the expiration of three calendar months next after the marriage of my said Wife
And subject and without prejudice to the trusts aforesaid I direct that the said residuary trust moneys and premises shall be held Upon trust for my Child if only one or all my Children if more than one who either before or after my decease being a Son shall attain the age of Twenty one years or being a daughter or daughters shall attain that age or be previously married with the consent of her or their guardians for the time being and if more than one as tenants in common but not in equal shares it being my intention that the share of my Son if he shall attain a vested interest under the trust last aforesaid shall be to the share of each of my daughters who shall attain a vested interest under the same trust in the proportion of two to one And in case I shall have only one child who shall attain a vested interest under the trust last aforesaid then the said residuary trust moneys and premises shall be wholly held in trust for such one child absolutely Provided always and I hereby declare that the share of every or any daughter of mine in the said residuary trust moneys and premises shall be for her sole and separate use
And if there shall be no child of mine who being a Son shall attain the age of Twenty one years or being a daughter or daughters shall attain that age or marry Then as to the capital and income of my said residuary trust moneys and the stocks funds and securities representing the same In trust (subject to the annuity given to my said Wife if she be living and married again) for my Brother George Clarke Bellairs absolutely if he shall be living at the decease or second marriage of my said Wife or failure of issue which shall last happen but if he be then dead then In Trust to pay the income of the said residuary trust moneys (subject to the said annuity) unto my Sister Dora Mary Allford for her life for her sole and separate use without power of anticipation and from and immediately after her decease Upon Trust to stand possessed of the said residuary trust moneys and the stocks funds and securities representing the same and the annual income thereof In Trust for Henry George Lynwood Allford and Alice Edith Allford the Son and Daughter of the said Dora Mary Allford in equal shares the share of the daughter to be for her sole and separate use
I empower the Trustees or Trustee for the time being of this my Will to apply all or any part of the yearly income to which under any of the bequests or dispositions hereinbefore contained each or any infant Legatee shall be entitled or contingently entitled in possession towards the maintenance and education or otherwise for the benefit of such legatee during his or her minority or at the option of such Trustee or Trustees to pay the same into the hands of the parent or guardian of such legatee to be so applied but for the application whereof by such parent or guardian such Trustees or Trustee shall not be responsible and I empower the Trustees or Trustee for the time being of this my Will with the consent of my said Wife during her life and after her decease at the discretion of such Trustees or Trustee to advance and apply any part not exceeding one half of the Capital to which under any of the said bequests or dispositions each of any Infant legatee shall be entitled or presumptively entitled in or towards his or her advancement or preferment in the World
I devise all estates vested in me upon any trust or by way of mortgage unto and to the use of my Trustees their heirs and assigns but subject to the trusts and equities of redemption respectively subsisting therein
I appoint my said Wife guardian of my Infant Children during their minority Provided always and I hereby declare that the said George Bellairs and William Jesse Freer or either of them and every Trustee of this my Will who shall be a Solicitor may act as Solicitors to my estate and shall be entitled to charge and shall be paid for all business done by them or him as Solicitors in respect of my estate in the same manner as if they or he had not been Trustees or Executors of this my Will
And lastly I revoke all former Wills by me at any time heretofore made and declare this only to be my last Will and Testament

The bond stops abruptly at this point, it should have continued to say that Ann Draycott was to produce inventory and administer estate, but both bound individuals have made their mark at the bottom of the page. On the reverse it says that Ann Draycott was sworn administratrix 17 January 1712.

Provided always it is my Will And I do hereby expressly declare that for the purpose of paying the aforesaid Legacy of Five hundred Pounds or any money that may be required for the purpose of carrying out the Trusts of this my Will that it shall be lawful for my said Trustees or the Survivor of them to raise the same or any part thereof at any time and in such manner as they may consider necessary by Mortgage of the said last mentioned hereditaments or a competent part thereof And for that purpose by any deed or deeds instrument or instruments in writing by them duly executed and attested to grant or appoint the said hereditaments or any parts thereof to such person or persons for such uses and in such manner as they or he shall think proper for the purpose of effecting any such Mortgage as aforesaid And I expressly declare that the person and persons paying money to my said trustees on any such Mortgage as aforesaid shall not be bound to ascertain or enquire that the same is wanted for the purposes aforesaid or to see to the application of the money advanced by him or them or be accountable for the misapplication of the same

I devise and bequeath all my real and personal estate to my said Wife Mary Ellaby during her natural life and I direct that she shall pay thereout my debts funeral and testamentary expenses and the said annuity and that she shall be at liberty to use and enjoy my said real and personal estate in any way she thinks fit and to carry on my farming business and after her death I devise and bequeath my said real and personal estate (subject nevertheless to the payment of the said annuity) to my Trustees Daniel John Barker of Holwell Farmer and Josiah Gill of Melton Mowbray Chemist their heirs executors administrators and assigns Upon trust to sell and convert the same into money and (after paying or providing for the said annuity) to divide the net monies arising from my said real and personal estate equally between such of my said Wife’s four children (namely) Mary Ann Gardner Gill Daniel John Barker John Gardner Barker and Julia Ann Westerdale as shall be living at the time of the death of the survivor of me and my said Wife
But if any of my said Wife’s children shall die before the death of the survivor of me and my said Wife and shall leave a child or children then living such last mentioned child or children shall take (and if more than one equally between them) the share which his her or their parent would have taken under this my Will if such parent had survived me and my said Wife
And I appoint my said Wife Mary Ellaby sole Executrix of this my Will
I devise all estates vested in me upon any trust or by way of mortgage to the said Daniel John Barker and Josiah Gill subject to the trusts and equities affecting the same

And from and after the decease or second marriage of my said Wife I give and bequeath all my said personal Estate and Effects to my said Son Edward his executors administrators and assigns subject nevertheless to the payment of the Legacies hereinafter mentioned
I give and bequeath to my daughter Mary the Wife of Edward Smith of Nottingham to my daughter Ann the Wife of John Pearson of London to my daughter Sarah the wife of Thomas Clayton of Thorpe Arnold to my daughter Charlotte the wife of Samuel Beswick of London to my daughter Elizabeth Hallam and my daughter Vashti Hallam a Legacy or sum of fifty pounds each all which said several Legacies I will shall be paid within twelve calendar months next after the decease or second marriage of my said Wife which shall first happen the said Legacies to be vested interests in the said Legatees respectively immediately upon my decease but subject to the Proviso or condition hereinafter contained that is to say

I give and bequeath to my grandson John Hallam a Legacy of Thirty pounds and to my Grand daughter Mary Hallam a Legacy or Twenty pounds to be paid to them respectively when they shall severally attain their respective ages of twenty one years but without any interest in the mean time Provided always that in case my said Grand son or Grand daughter shall depart this life under the age of twenty one years his or her said Legacy shall not be paid but shall sink into and form part of the residue of my said personal Estate
And I do hereby further will and direct that in case my said Son Edward shall depart this Life unmarried and without leaving lawful issue before the decease or second marriage of my said Wife then and in such case from and immediately after the decease or second marriage of my said Wife which shall first happen subject in the first place to the payment of a Legacy of Ten pounds each to the Husband of any of my daughters who may then be dead leaving a Husband I give and bequeath all the said residue of my said personal Estate and Effects unto and equally between and amongst all and every my children who shall be then living and the issue of such of them as shall be then dead leaving issue and my said two Grand children share and share alike provided always that the issue of any deceased child shall only have or be entitled to one proportionate share equally amongst them and my said two Grand children one proportionate share equally between them
Provided further that in case either of my said Grand children John Hallam and Mary Hallam shall depart this life under the age of twenty one years then the share of him or her so dying shall go to and be equally divided between and amongst my said children or their issue and my other Grand child in manner hereinbefore mentioned
I make constitute and appoint the said James Stokes and James Musson joint Executors of this my Will And my Will and Meaning is and I do hereby expressly declare that my said Trustees and Executors and their respective executors and administrators shall and lawfully may by and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid retain to and reimburse themselves respectively all such loss costs charges damages and expences as they or either of them shall or may sustain or be put to in the execution of the Trusts hereby in them reposed or any thing relating thereto And further that they shall not be answerable or accountable for any monies to be by them or either of them placed out at interest or deposited for safe custody or otherwise that may be lost nor for any loss damage or diminution in value of my said Stock personal Estate and Effects whatsoever or any part thereof unless it be through their or his own wilful neglect or default And that they shall not be answerable or accountable the one for the other of them or for the Acts receipts neglects or defaults of the other of them but each of them only for his own separate Acts receipts neglects and defaults
Lastly I hereby revoke and make void all former and other Wills by me made and I declare this to be my last Will and Testament

In the name of God Amen November the 20th 1722 According to the Computation of the Church of England I Valentine Kitchin of Goadby Marwood in the County of Leicester being of perfect memory and remembrance praised be God do make and ordaine this my Last Will and Testament in manner and form following viss
First I bequeath my Soul into the hands of Almity God my maker hoping that through the meritorious death and passion of Jesus Christ my only saviour and redeemer to receive free pardon and forgiveness of all my sins and as for my Body to be Buried in Chrisstian Buriall
Itm I Give unto my wife and my daughter Agneese all my Goods and Chattles for their lives and after theire decease unto my Granchildren the sons and daughters of Will Kitchin my son deceased equily to be divided Amongst them by the decretion of two honest neighbours and John Kitchin my Granson which I make Trustee hoping he will looke that Justiss be don on all sides
Memorandam itt is my will and pleasure that my granchildren James Linnee and Elizebeth Linnee shall have part with the rest of my granchildren
Also itt is my will to give my son Will Linnee one Shilling to be pade within ten days After my desease
Also it is my will that my daughter Agneesse shall have what shee [one word partly lost in fold]
Also it is my will that which soever departeth this world first it is my will that shee shall not dispose of any thing but leave All unto the surviveer
Also it is my will and pleasure that when the surviveer departeth this world that shee shall not Give or dispose of any thing with a dissine to hinder the surviveers my granchildren so it is my will and pleasure that my grandchildren shall injoy what is left

Valentine Kitchin lived in a large T shaped cottage - no. 91 on the above detail from the 1839 tithe survey map. The building occupied the site of what we know today as Norman Cottages.
Norman Cottages c. 2010. These pretty cottages were built in the mid-19th Century and named after George Norman who lived at Goadby Hall.
